You are innocent until proven guilty. Use my experience as trial lawyer to make the state prove the charge or dismiss.
Tell your side of the story through the Constitutional Right to a Jury Trial. You can ask the state to show you evidence. If the State can't prove the case beyond a reasonable doubt then they must acquit.
Someone close to me has been arrested. Now what?
If you or someone you know has been arrested, you have a right to remain silent. Do not talk to anyone about your charge except someone who is bound by the law to keep your conversation private. Within 72 hours of arrest, bail will be set and you want it set low. The Judge wants to know that you will appear at future hearings and will order 'pre-trial conditions.' If you are charged with a DUI, this may 'no driving without valid license and insurance.' If its an assault charge, you will likely be asked to have no contact with the alleged victim.
Where Does the Case Go From Here?
A case can go in 3 directions, but normally, a case will be continued many times before any of these occur. (When a case is continued, you or the prosecutor asks for more time to interview witnesses, gather evidence, research caselaw, or negotiate a deal)
- Guilty Plea
- Dismissal
- Trial (Conviction or Acquittal)
